1. Agreement to These Terms
These Terms of Service ("Terms") govern your access to and use of ABAB OK, including ababok.com, our mobile applications, AI features, content, and related services (collectively, the "Services"). The Services are provided by ABAB Labs ("ABAB Labs," "we," "us," or "our").
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
The English version of these Terms controls to the extent permitted by law if a translation conflicts with it.
2. Eligibility and Accounts
- You must be at least 13 years old to use the Services.
- If you are under 18, you may use the Services only with permission from a parent or legal guardian.
- You must provide accurate account information and keep it current.
- You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
- You may not transfer, sell, or share your account except as expressly permitted by us.
3. The Services and AI Features
ABAB OK provides AI-powered information, drafting, research, productivity, and assistant features. The Services may use OpenAI and other third-party model or API providers to process your inputs and generate outputs.
AI technology is probabilistic. Outputs may be inaccurate, incomplete, outdated, offensive, or not suitable for your situation. You are responsible for reviewing, verifying, and deciding whether to use any output.
4. Professional Information Only
ABAB OK is a general AI assistant. The Services do not provide legal, financial, medical, tax, immigration, or other professional advice and are not a substitute for advice from appropriately licensed professionals.
AI output may be inaccurate, incomplete, outdated, or not suitable for your situation. You are responsible for independently reviewing and verifying output before making decisions or taking action that may affect your rights, obligations, health, finances, property, or safety.
Do not use the Services for emergencies or matters requiring licensed professional judgment.
5. Your Content
You may provide prompts, messages, files, documents, feedback, and other content to the Services ("Input") and receive AI-generated or service-generated content ("Output"). Input and Output are together "User Content."
You retain any rights you have in your Input. You grant ABAB Labs a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, and use User Content solely as reasonably necessary to provide, secure, support, maintain, enforce, and improve the Services and as otherwise described in our Privacy Policy.
You represent that you have all rights, permissions, and legal bases needed to provide Input to the Services and to allow us and our service providers to process it.
6. Output and Responsibility
To the extent permitted by law and subject to these Terms, you may use Output for your personal or internal business purposes. Output may not be unique, and other users may receive similar or identical outputs.
You are solely responsible for your use of Output, including any decision, document, communication, filing, transaction, or publication you make based on it. You must evaluate Output for accuracy, legality, suitability, and non-infringement before using it.
7. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law, regulation, court order, contract, or third-party right;
- Submit content you do not have the right to share, including confidential, privileged, or personal information of others without authorization;
- Generate or distribute unlawful, harmful, deceptive, defamatory, harassing, hateful, sexual, exploitative, or violent content;
- Harm, exploit, or target minors, or collect personal information from minors without required consent;
- Provide professional legal, financial, medical, immigration, tax, insurance, employment, housing, credit, or similar advice to others without proper qualifications and review;
- Make decisions that produce legal or similarly significant effects about a person without appropriate human review and legal compliance;
- Develop malware, facilitate cyber abuse, bypass safety systems, scrape the Services, reverse engineer models or systems, or interfere with service operation;
- Misrepresent AI-generated content as human-generated when that would be deceptive or unlawful;
- Use the Services to infringe, misappropriate, or violate intellectual property, privacy, publicity, or other rights.
You must also comply with the applicable terms and usage policies of third-party providers whose technology is used in the Services.
8. Third-Party Services and AI Providers
The Services may interoperate with third-party services, including AI model providers, cloud hosting, analytics, payment processors, app stores, authentication providers, and customer support tools. We are not responsible for third-party services that we do not control. Your use of third-party services may be subject to their own terms and policies.
9. Privacy and Consent to AI Processing
Our Privacy Policy explains how we process personal information. By submitting an AI request, you instruct and authorize us to send the information needed to process that request to third-party AI/model providers, including OpenAI and other model providers, as described in the Privacy Policy. In the app, we may request additional explicit consent before sharing personal information with third-party AI providers.
10. Purchases and Subscriptions
We may offer paid features or subscriptions. Prices, billing terms, renewal terms, cancellation options, and taxes will be disclosed at the point of purchase or in the applicable app store or payment processor flow.
If you purchase through Apple, Google, or another app store, your purchase is also governed by that app store's terms and refund rules. Except where required by law or the applicable platform rules, fees are non-refundable.
11. Our Intellectual Property
The Services, software, interfaces, designs, trademarks, logos, and other ABAB Labs materials are owned by ABAB Labs or its licensors and are protected by intellectual property laws. Except for rights expressly granted in these Terms, we reserve all rights in the Services.
12. Suspension and Termination
We may suspend or terminate your access to the Services if we believe you violated these Terms, created legal or security risk, caused harm to the Services or others, or if we are required to do so by law. You may stop using the Services at any time.
13. Disclaimers
The Services are provided "as is" and "as available." To the maximum extent permitted by law, ABAB Labs and its affiliates, providers, and licensors disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and error-free operation.
14. Limitation of Liability
To the maximum extent permitted by law, ABAB Labs and its affiliates, officers, directors, employees, agents, providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, business interruption, or cost of substitute services. To the maximum extent permitted by law, our total liability for all claims relating to the Services will not exceed the greater of the amount you paid to ABAB Labs for the Services in the 12 months before the claim or USD $100.
15. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless ABAB Labs and its affiliates, officers, directors, employees, agents, providers, and licensors from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your User Content, your use of the Services, your Output, your violation of these Terms, or your violation of any law or third party right.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of California and the laws of the United States, without regard to conflict-of-law rules, except that mandatory consumer protection laws may apply. Unless applicable law requires otherwise, courts located in California will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services.
17. Changes and Contact
We may update these Terms from time to time. If changes are material, we will provide notice as required by law. Your continued use of the Services after updated Terms become effective means you accept the updated Terms.
